Los Angeles California Unpaid Overtime Claims
If you are an employee who works either more than eight hours in one day, or more than 40 hours in one week, you may be entitled to overtime pay. California law requires that employees be compensated at a premium rate of pay for overtime work. A Los Angeles employee who has not been paid for overtime worked pursuant to California law has the right to seek past due premium pay from his or her employer. An employee who is due premium overtime pay may also be entitled to additional damages, such as waiting time penalties, from his or her employer. An employer who fails to pay its employees for overtime worked often times also will fail to provide meal breaks and rest periods, reimburse employees for mileage expenses, or otherwise adhere to California employment law.
Misclassification of Los Angeles Employees
Under California wage and hour laws, salaried employees can also be entitled to overtime pay for working more than eight hours in one day, more than forty hours in one week, or working seven days in a row without a day off. Employers may misclassify certain employees as exempt, a status under which premium payment for overtime is not required. An exemption is applicable, for example, for employees who spend over half their work time managing businesses or departments of a business. “Misclassification” is where employers inaccurately designate an employee as exempt from overtime laws. It is a not an uncommon practice in California, but is prohibited by California law. If you work in Los Angeles, or any other part of California, including San Diego, Orange County, or San Francisco, and believe you have been misclassified as exempt by your employer, you may be entitled to premium overtime pay for hours you have worked.
