Orange County Employees Right To Unpaid Overtime
Employees are often required by their employers to work more than eight hours a day, or more than forty hours a week. Often times, this is because employers assign daily duties for their employees that require more than an eight hour scheduled shift to complete. In some instances, employers more directly require an employee to work overtime. Regardless of the reason, some employers do not properly pay overtime compensation that an employee is entitled to when he or she works more than eight hours in one day or more than forty hours in one week. California and federal laws, however, require that employees be compensated at a premium rate of pay such overtime work.
Right To Overtime Pay Based On Misclassification
Salaried employees in California may also be entitled to overtime compensation when they are misclassified as exempt from receiving overtime pay. In certain instances, employees may be classified as exempt based on a classification of the employee as administrative, executive, or professional. Misclassification, as this practice is commonly referred to, can be the result of an employer’s intentional designation of an employee as exempt in order to avoid payment of overtime wages.
However, this practice of misclassification is illegal. Wage and hour laws require that a California employee be paid time-and-one-half for hours worked in excess of eight in one day or forty in one week. California law requires that an employee be paid double time for work in excess of twelve hours in one day or in excess of eight if an employee works seven days in a rwo.
